Documents Requiring Translation for ILR

Indefinite Leave to Remain applications (SET(M) partner, SET(O) work, SET(LR) long residence, and settlement categories under Appendix Continuous Residence) require evidence of qualifying continuous residence, the applicant's and dependants' identities, and a clean criminality history. Where any document is issued in a language other than English or Welsh, UKVI requires a certified translation. Typical evidence includes:

• Police clearance certificates from every country of residence for 12 months or more in the last 10 years. UKVI treats the sealed block, the QR-verification code and the expiry statement as the certificate's authenticity markers; all three must appear on the translation.
• Marriage and civil partnership certificates where the ILR category rests on a partner relationship (SET(M)).
• Birth certificates of dependants being included on the ILR application, with both parents' details preserved.
• Overseas employment records: payslips, employer letters, P60-equivalents and social-security statements for any qualifying continuous-residence period spent abroad.
• Bank statements supporting maintenance evidence where relevant, and demonstrating the applicant's or the sponsor's continued financial base.
• Divorce decrees where an earlier marriage needs to be shown as dissolved for the partner category to qualify.
• Absence-record evidence: entry and exit stamps, travel confirmations, employer letters covering absences for work reasons.
• Life-event certificates: death certificate of a spouse for the bereaved-partner route, or medical evidence for the compassionate discretion routes.

Why UKVI Refuses ILR Applications on Translation Issues

Settlement refusals typically cite continuous-residence shortfalls, criminality concerns or evidential gaps rather than eligibility ones. Where the translation is the weak link, the caseworker records the refusal against the specific rule the untranslated document was meant to satisfy. Common translation-side reasons on refusal notices:

• Police certificates with untranslated seals or QR-verification blocks. UKVI treats the sealed block as the authenticity marker; if it is not in English, the certificate is not considered valid evidence for the criminality check.
• Partial translation of overseas employment records. Absences for work reasons under Appendix Continuous Residence rest on employer letters that include the reason, the dates and the return date; a summary is not the same evidence as the full letter.
• Untranslated marginal notes on civil documents. A note recording a name-change, a re-registration or a divorce absolute is often the single most important line on the certificate.
• Divorce decrees translated as a summary. The operative wording (typically "the marriage is dissolved" or an equivalent) and the effective date must appear on the translation; a summary of the effect is not enough.
• Name-transliteration inconsistencies across a 5-year or 10-year pack. Where documents span more than a decade, the transliteration must be identical to the passport spelling on every page, even where the source uses an older romanisation convention.

Para 39B Requirements Met as Standard

Paragraph 39B of the Immigration Rules sets the four elements a Home Office caseworker checks on any foreign-language document. Every ILR translation we issue carries all four on the same page as the translated text:

• Statement of accuracy from the translator confirming the translation is complete and accurate.
• Date of translation so the caseworker can see the pack is current.
• Translator's full name and signature, not the agency's trading name alone.
• Translator's contact details and professional affiliation for Home Office verification.

Notarisation is not required for the ILR route and does not strengthen the application. The Home Office asks for a certified translation; anything above that is administrative overhead and slows the pack down.

Continuous Residence and Absence-Record Evidence

For SET(O), SET(M) and SET(LR), UKVI checks continuous residence against Appendix Continuous Residence limits: 180 days in any 12-month rolling period across the qualifying window. Where absences were for work-related reasons, the employer letter has to make that clear: reason for absence, dates, the fact of return.
